Changing and Deleting Your Personal Information

Please note that after The Delmar Loop processes a change or deletes your personal information from active The Delmar Loop systems and databases, it is possible that non-active residual copies of your information may still exist in The Delmar Loop systems and on archive or backup media.
Your Consent
Other than for European Union citizens, your use of any of The Delmar Loop Services constitutes your consent to the collection and uses described in this Privacy Policy of your information by The Delmar Loop (and Target Third Parties, in which case, once such Target Third Party is in possession of your information, we cannot control such Target Third Party's use of your information). Electronic Newsletters
We offer free, electronic newsletters, updates and e-mail reminders as a service to our registrants, based upon your voluntary subscription. You will only receive an electronic newsletter if you have requested it (opted-in). We may share mailing lists between our clients and members for legitimate business purposes. Additionally, to minimize duplicative e-mails and other electronic messages we do correlate user e-mail addresses with Facebook users through a service provided by Facebook, although it is our understanding that Facebook does not retain any of this data.

Information Collected by The Delmar Loop Mobile App
The Delmar Loop's primary objective in collecting user information in the mobile app is to provide and enhance the Service and to enable users to enjoy the Service. When you install any of the Services, The Delmar Loop may collect and record the information you provide to The Delmar Loop, whether through the Services or through social network or other third party services ("Account Information").
CATEGORIES OF PERSONAL INFORMATION WE COLLECT
Passive Information
Passive information refers to information that is automatically collected from your device(s) when you access the App and use the Services. The Delmar Loop may collect passive information such as your mobile device type or geographic location. Your device typically sends passive information to our servers without your intervention whenever you visit our Apps and use the Services. For example, your device may tell the type device you are using. When you use App, the app's server may also tell us information such as the page or link that led you to Apps and the pages you visit inside of the app.
Personal Information
Personal information means information that it is specific to you and can be used to contact or identify you. By accessing the Service through a social network, mobile device or other third party platform or service or by connecting to such a third party network, platform or service via a Service, you are authorizing The Delmar Loop to collect, store, and use in accordance with this Privacy Policy any and all information that you agreed the social network, mobile device or other third party platform could provide to The Delmar Loop through the social network/mobile device/third party platform Application Programming Interface (API) based on your settings on the third party social network, mobile device or platform. Your agreement takes place when you connect with the third party network, platform or service via the Service, and/or when you connect with a Service, or "accept" or "allow" (or similar terms) a Service to access your information through a social network, mobile device or other third party platform or service. If you choose to access the Service by using your Apple ID as your login, we may receive from Apple certain categories of personal information about you that you authorize Apple to disclose, such as your email address, or you may voluntarily disclose information such as your gender or your preferences to us through your use of the Services.

Your participation in online game events is conditional upon you granting The Delmar Loop permission to collect, use, store, transmit and display publicly statistical data, such as your scores, rankings and achievements, generated through your participation.
Email and Text Messaging Marketing
In addition, The Delmar Loop may use personal information to communicate with you through email regarding new products, new features, product updates, enhancements, special offers, or promotions for the application services. These communications may also include offers from The Delmar Loop marketing partners. Emails we send you may include a web beacon that tells us whether and at what time you have received or opened the email or clicked a link within the email. If you do not want us to use your personal information in this way, or to provide your personal information to third parties for their marketing purposes, please uncheck the appropriate box when you register or you can opt out by contacting us at director@thedelmarloop.com. You can also opt out by clicking on the "unsubscribe" button on the emails or turning off The Delmar Loop application push notifications in the Account Settings in the App or in the Settings on your smartphone.
Use of Passive Information
The Delmar Loop collects passive information for purposes of tracking and analyzing user preferences and trends in order to improve the quality and design of the Services and to create new features, promotions, and functionalities; for editorial and feedback purposes; for marketing and promotional purposes; for content improvement; and to customize the Services. This information may also be shared with advertisers and our business partners on an aggregated anonymous basis.
Deleting Your Information
If you would like The Delmar Loop to delete your record in its system, you may do so by navigating to the Account page within The Delmar Loop App, scrolling down to the bottom of your Account profile and clicking "DELETE ACCOUNT." Your personal data will be deleted both on your device and on The Delmar Loop servers and your Delmar Loop App will be reset. If you have further questions about deleting your personal data or you would like to request certain data to be deleted without deleting your account, please contact The Delmar Loop at director@thedelmarloop.com and it will accommodate your request if it is not legally obligated to retain the record. If you have granted The Delmar Loop access to your Account Information through a Service, you may request deletion of your Account Information by dissociating or removing The Delmar Loop application from your social network or third party service account in accordance with the instructions provided by the social network or third party service.
Children's Privacy and The Delmar Loop Website Age Limitations
The Delmar Loop Services are intended for use by persons aged 18 or older. The Delmar Loop does not knowingly allow use of The Delmar Loop Services by any person that The Delmar Loop believes to be younger than 18. The Delmar Loop also does not collect any personally identifiable information from any persons under the age of 18 and if we discover that we have been provided any such information, we will delete this information from our records.
Contests and Promotions
From time-to-time, The Delmar Loop may operate contests or promotions through The Delmar Loop Services or otherwise by itself or with one or more participating or co-sponsoring organizations. In addition to the official rules that apply to such contest or promotion, The Delmar Loop may request information from users of The Delmar Loop Services who choose to participate in such contests or promotions. Information requested may include contact information (such as name and address), and demographic information (such as zip code and age). If you choose to participate in one of these contests or promotions, the other participating organizations, co-sponsors and their affiliates may also receive and use the information collected or may collect the information directly, and the use of such information shall be governed by the respective privacy policies of such participating organizations, co-sponsors and their affiliates. Other than for European Union citizens, your participation in a contest or promotion through The Delmar Loop Services or otherwise shall be deemed to be consent to the receipt and use of such information by The Delmar Loop, as well as these other participating organizations, co-sponsors and their affiliates.

The Delmar Loop (East Loop Community Improvement District) Agreement For Use of User-Generated Content
This Agreement for Use of User-Generated Content (the "UGC Agreement") describes the terms and conditions under which The Delmar Loop (East Loop Community Improvement District) ("The Delmar Loop") may use certain content created and publicly posted by you the "User-Generated Content"), that is identified in The Delmar Loop's communication to you via email, text message or the social media platform or website on which such User-Generated Content appears.
By replying "Y", "#YES" or "YES" or clicking "I Accept" or "I Agree", you agree to the terms and conditions of this UGC Agreement.
License Grant
In consideration of the possible use of the User-Generated Content by The Delmar Loop and the promotional and other value that you may obtain from such use and The Delmar Loop's reasonable efforts to provide attribution to you of such User-Generated Content, you hereby grant to The Delmar Loop a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right and license to use, copy, display, edit, excerpt, modify, reproduce, publish, perform, stream, broadcast, archive, publicize, promote, use in compilations, and make derivative works from (and to authorize third parties to exercise such rights on behalf of The Delmar Loop) the User-Generated Content on any and all of The Delmar Loop's websites, blogs, mobile sites and apps, emails and other The Delmar Loop-branded digital and social media sites, channels, and promotions whether now know or hereafter existing.
You agree that (i) the User-Generated Content was created by you or that you own or control all rights in such User-Generated Content; and (ii) the exercise by The Delmar Loop of its rights under this UGC Agreement will not violate the rights of any third party or any applicable laws or regulations.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT SHALL THE DELMAR LOOP, ITS MEMBERS OR AFFILIATES (OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR OTHER AGENTS) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE USE OF THE USER-GENERATED CONTENT OR THIS UGC AGREEMENT, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION.
Indemnity & Release
You agree to indemnify, defend and hold The Delmar Loop, its agents, suppliers, licensees, successors, or assigns, and/or its and their respective officers, directors, employees, contractors and agents (collectively, the "Indemnified Parties") harmless from and against any and all damages, liability, claims, actions, demands and costs (including, without limitation, reasonable attorneys' fees and costs of settlement) arising out of any breach by you of this UGC Agreement. You also hereby release each of the Indemnified Parties from all damages, liability, claims, actions, demands and costs of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with this UGC Agreement.
Choice of Law and Venue
This UGC Agreement shall be governed by the laws of the State of Missouri, without regard to its conflict of law principles. Jurisdiction for any claims arising under this UGC Agreement shall lie exclusively with the state or federal courts in Saint Louis, Missouri.
Children's Privacy and Age Limitations of The Delmar Loop Services
The Delmar Loop Services are intended for use by persons aged 18 or older. The Delmar Loop does not knowingly allow use of The Delmar Loop Services by any person that The Delmar Loop believes to be younger than 18. The Delmar Loop also does not collect any personally identifiable information from any persons under the age of 18 and if we discover that we have been provided any such information, we will delete this information from our records.
Advertising
Some The Delmar Loop Services are supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on The Delmar Loop websites and/or mobile applications, queries made through The Delmar Loop Services or other information. The manner, mode and extent of advertising on The Delmar Loop Services are subject to change without specific notice to you. By accessing and using The Delmar Loop Services, you agree that The Delmar Loop Services may place such advertising through The Delmar Loop Services.
Contests and Promotions
